Someone Didn’t Pay Me Back…What Can I Do?
Someone owes you money, what can you do? The answer is… It depends. Do you have a contract and how clear are the terms of that agreement?
If you don’t have a formal written contract, it may be more challenging but not impossible to prove you had an agreement and that your opposing party owes you money. Don’t be dissuaded by the lack of a formal written agreement.
What does count as a contract?
- Emails
- Text messages
- Oral agreements
Even without an official contract, other legal theories allow you to collect for goods or services you have provided and not been paid for. An experienced attorney can walk you through that process.
In any event, if you go to court, your case can go many different ways depending on the other side’s response. Court takes a long time, but sometimes going to court is necessary and you should be prepared for the long haul!
